SNOWSPORTS ST. MORITZ AG

General provisions and scope of application

Unless expressly agreed otherwise, these General Terms and Conditions apply to all business transactions between Snowsports St. Moritz AG and its customers. The company’s business purpose is the operation of a snow-sports, bicycle, and mountain sports school. This includes services such as giving lessons concerning the skills and knowledge of snow-sports and mountain outdoor activities without guarantee of a determined training success, as well as guiding and accompanying activities during winter and summer sports. The ski, snowboard, cross-country skiing instructors, mountain guides, hiking guides and bicycle guides are hereinafter referred to as “course instructor”. For reasons of readability, the masculine form is used when referring to persons, but the feminine form is always included.

Booking

By booking, the customer accepts the GTC as an integral part of the contract between themselves and Snowsports St. Moritz AG. Any wishes and concerns regarding dietary requirements, medical needs, etc. must be communicated directly to the course instructor in advance before the start of the activity (at least 48 hours in advance), so that the course instructor can take the adequate measures.

Prices

Prices are indicated in swiss francs. For payments in euros or other foreign currencies, the corresponding current exchange rate of the service provider will be applied. Unless otherwise stated in the detailed offer description, the price includes the cost of the lesson, course, or tour. The prices do not include personal catering, rental equipment, and transportation costs to/from the mountain (cable cars, taxi or public transport).

Payment terms

The total amount of the agreed service is due 48h before the start of the activity and is only confirmed upon receipt of payment. In the event of late payment, there is no right to the realization of the activity. Exception:  For  short-term  bookings  within 48  hours,  the reservation is considered confirmed and is therefore subject to a fee and must be paid immediately.

Credit card payment

Credit card payments in favor of Snowsports St. Moritz AG are collected by TREKKSOFT AG, Hauptstrasse 15, 3800 Matten, Switzerland ("TREKKSOFT"). TREKKSOFT will appear as TREKKSOFT TOUR BOOKING on your credit card statement. The website domain used to enter and process payments is owned and operated by TREKKSOFT. For all inquiries regarding credit card payment and chargeback, the customers shall contact support@payyo.ch directly by mail.

Cancellation or modification of the bookings by the customer

The cancellation of bookings must be made in writing by e-mail to info@skischool.ch at least 48 hours before the start of the activity. In case of cancellations made later by the customer, the full rate of the booking will be charged. Cancellations for bookings made at short notice within 48 hours can no longer be accepted free of charge.

Each lesson or group course that is started will be charged in full, regardless of whether it must be ended prematurely.

Cancellation or modification of the bookings by Snowsports St. Moritz AG before the start of the activity

Snowsports St. Moritz AG reserves the right to change or cancel the program or individual services, even at short notice, after conclusion of the contract, if natural and/or weather conditions or other unforeseeable circumstances (force majeure, official imposed measures or other risks) make this necessary. The refund will be made in the form of a voucher.

Change of program or cancellation of the activity after the start of the activity or within 48 h prior to it.

Snowsports St. Moritz AG reserves the right to change the activity program or some of the agreed services if external circumstances (e.g. force majeure, weather and natural conditions, officially imposed measures or safety risks) make it necessary.

Group lessons

Group lesson tickets are non-transferable. Group lessons are held with a minimum of four participants per skill level, for the Snowli Kids Village lessons with a minimum of three participants per skill level. In case of fewer participants, Snowsports St. Moritz AG reserves the right to combine classes with different skill levels at short notice, to move them to another location, to shorten or to cancel the lessons. Tickets for lunch can be refunded only upon return of the ticket on the same day.

Liability

Snowsports St. Moritz AG expressly excludes any liability for accidents during lessons and competitions or any liability claims in relation to the services provided by Snowsports St. Moritz AG. No claims (for damages) may be made based on errors in illustrations, prices and texts.

Insurance

Insurance (health and accident insurance incl. sports accidents etc.) is the responsibility of the participant. It is recommended that customers take out insurance for cancellation costs and repatriation.

Claims

Any claims or damages incurred must be notified to Snowsports St. Moritz AG in writing by e-mail to info@skischool.ch and not later than four weeks after the end of the activity. All claims will be void in the event of a claim being made later.

Data privacy

Snowsports St. Moritz AG reserves the right to use image material of all services provided for marketing purposes. Consent for the use and disclosure of data and images can be revoked at any time by contacting us at info@skischool.ch. The necessary data for the processing of business transactions are treated confidentially.

Jurisdiction

The registered head office of Snowsports St. Moritz AG in St. Moritz is the place of performance. The exclusive place of jurisdiction is St. Moritz and swiss law applies.
